Information about the new working time regulations
From 1 January 2026, new rules regarding daily rest periods and the length of work shifts will come into effect at Vitklöver Assistans. The purpose of these changes is to ensure a good working environment, sufficient recovery for assistants, and that the organization complies with applicable legislation and collective agreements.
The requirement of at least 11 consecutive hours of daily rest per 24-hour period has been a main rule in the EU Working Time Directive (2003/88/EC) since 2003. Following criticism from the EU in 2021, previous Swedish exemptions have been reviewed and tightened.
The collective agreement for personal assistance has therefore been updated with new provisions that will come into effect at the turn of the year 2025/2026. It is very important that these rules are followed, both for the working environment and to ensure that Vitklöver Assistans complies with applicable requirements.
Main rule
At least 11 consecutive hours of daily rest per 24-hour period.
Exceptions and planned solutions
From 1 January 2026, an MBL negotiation is required when introducing or changing exemptions.
Shortest daily rest: 9 hours
- May be combined with work shifts of up to 15 hours.
- Compensation is provided immediately after the shift or in connection with the next rest period.
Work shifts of 15–20 hours including on-call duty
- At least 5 hours of on-call duty between 10:00 p.m. and 8:00 a.m.
- Rest equivalent to the length of the work shift after the shift.
Work shifts of 20–24 hours including on-call duty
- Only if necessary to meet the client’s needs.
- Rest equivalent to the length of the work shift after the shift.
Work shifts of 15–20 hours without on-call duty
- Requires a local agreement.
- Rest equivalent to twice the length of the work shift.
Work shifts of 20–24 hours without on-call duty
- The trade union party may reject the schedule.
- Rest equivalent to twice the length of the work shift.
Purpose
The purpose is to ensure the assistant’s working environment and recovery while continuing to meet the client’s needs.
